>> good morning. my clothes are feeling tighter. i know it's cliche, i definitely had my fill. time to hit the gym today or whatever you do. we have an he can check tick mix for you. we have a coffin company selling itself with naked women. i'll explain that later. or lewis will, actually. we begin with an update on the train derailment in new york. stretches of the commuter rail line are closed this morning after the deadly crash yesterday. we have new video just in of crews already back on the scene to get the trains uprighted. four people, of course, killed. 63 injured. 11 in critical condition. early morning commuter train

traveling south from poukeepsie, new york, to grand central station derailed in the bronx. 100 people were on the seven cars which came to a violent stop just short of the nearby river. the train was only about 12 miles from the destination. a lot of people, frankly, at that time in the morning dozing off when the cars tumbled off the tracks. >> as we were going over, i looked at my two and i screamed. we're going over. i couldn't believe it. i was in shock. >> i just felt the jerky moment. that's when everything happened very, very quickly. we saw the woman in the front of her go off through the other window. her glass broke. she hung on to the side rails like a monkey. and while the train was flipping and rocks were coming in. >> among the dead, donna smith of newburgh, new york as well as a member of the nbc news family, jim lovell who did audio for the

"today" show. three victims were thrown from the cars. rescue crews had to use air bags to physically lift parts of the train to free survivors trapped underneath. an official from the mta says the train operator reported the train was going too fast into the turn. according to "the new york times," the operator tried a last-ditch effort to slam on all of the emergency brakes. the train's conductor and engineer have both been hospitalized. federal investigators found the black box and will use it to determine exactly what went wrong. it is worth noting a freight train headed northbound derailed along the same curve back in july. buses helping get commuters to work this morning after the thanksgiving holiday. 26,000 people use this particular line to get in to the city. you're looking at live pictures of the scene. of course, they're getting the trains uprighted and getting them out of there as the investigation continues at both the federal, state, and city level. let's turn to washington.

white house officials are announcing they have met their deadline from improving healthcare.gov saying it will work smoothly for the vast majority of users. the repair team made 400 technical fixes and says the website with host 50,000 people at the same time. the obama administration also says the site is stable more than 90% of the time. healthcare.gov far from perfect. "the new york times" reports insurance companies are still not receiving all the information about individuals who sign up for coverage through the exchanges. and that creates a logistical nightmare for these guys. they need to track down that additional data and in some instances the insurance companies have no record that consumers signed up for coverage at all through the website. but former adviser to president obama david pluf insisted obama care will be viewed as a success even if it doesn't happen until after the president is out of

office. >> this program was designed to be implemented by the states. in most of the states running our exchanges is going quite well. you talk about medicaid. i think it's just a fact that it may take until 2017 when this president leaves offs, you'll see almost every state running their own exchanges and expanding medicaid. i think it will work really well then. >> let's fast forward to the state of the union and months after that. a lot of people signing up, economy sting continuing to strengthen. i think americans confidence will recover. >> a slew of international news to get to. start in afghanistan. american officials denying accusations from president karzai that the u.s. is withholding supplies to gain leverage in the negotiations between the two countries. karzai and his national security council say they believe the u.s. has cut off military supplies and fuel deliveries in order to pressure afghanistan into signing that new security agreement. u.s. embassy officials say that is simply not true.

the u.s. government seeking a new deal to keep american troops in afghanistan beyond 2014 but president karzai listed a set of conditions that must be met before he disagrees to an extended u.s. military presence. let's go to other overseas stories. thailand, overnight the prime minister vowing to open every door for talks with protesters demanding resignation. about 30,000 demonstrators taking part in what they call a people's coup. police have been using tear gas and water cannons to keep the protesters at bay. some of whom stormed the state television headquarters. the chaos forced the prime minister yesterday to flee a police compound. the critics say if you don't know the situation that her government is still controlled by her brother who the military removed as prime minister way back in 2006. at least four people have been killed in the clashes so far. there is also major unrest this morning in the ukraine. hundreds of protesters -- excuse me, hundreds of thousands of people taking to the streets to

find a government ban on protests. police use tear gas after crowds attacked the office of the country's president. the protests are in response to ukraine refusing to sign a trade deal with the european union which would have weakened the ties with russia. there is also video that appears to show police intentionally attacking a news crew that was covering the protests. euro news says the camera man suffered head injuries and all of his equipment was destroyed. it was something of a symbolic victory for supporters of mohamed morsiment they took control of the square in cairo. they were forced out by police. they've been holding daily protests demanding that morsi return to power. protests intensified after they also banned protests and demonstrations without government approval.

the death toll has climbed this morning in the deadly police helicopter crash in scotland. today crews begin the grisly task of sifting throughout wreckage again. the aircraft came crashing into it on friday night. among the dead, the chopper's three crew members. officials say more bodies could be inside the building. it's not really clear what caused the crash. apparent lit helicopter was turning from an operation when it went down. churches across the country filled sunday to remember those killed and the dozen injured as well. let's turn our attention to the business world. the holiday shopping season in full swing. wall street by the way on friday logged the third straight month of gains for november. stocks were mixed on the day. now for the month, the dow gained 2.6%. the s&p 500 up 1.9%. cnbc's steve sedgwick is live
